Terms of Use
for the Migraine Compass app and the optional Migraine Compass Plus subscription
1. Provider
The provider of the app is Benedikt Koßmann, Rohrdorf. Address and contact details are in the Legal Notice.
2. Scope
These Terms of Use apply to the use of the Migraine Compass app and the optional Migraine Compass Plus subscription. How the app handles data is described in the Privacy Policy.
3. Scope of services without a subscription
The app is a diary with which you log your migraine attacks and see your history. Without a subscription you can in particular:
- record attacks without limit, with pain intensity, aura, pain location, accompanying symptoms and triggers from the predefined list;
- record medication intakes with time;
- use the calendar and the statistics overview for the last 30 days;
- create one reminder, in discreet mode if you like;
- protect the app with a PIN;
- export your data completely as a JSON file.
You pay nothing for use without a subscription.
4. Migraine Compass Plus
With the paid Migraine Compass Plus subscription you additionally unlock:
- Trigger correlation
- Medication overview
- Weather and attacks
- Long-term statistics
- Unlimited reminders
- Daily symptom diary
- PDF overview
- CSV export
- Biometric lock
For the weather, the app transmits your rounded location to the weather service Open-Meteo; the details are in the Privacy Policy.
The price, term and renewal of the subscription are as stated in the store at the time of purchase. Google Play shows them to you before you complete the purchase.
5. Purchase via Google Play
You buy Migraine Compass Plus via Google Play. Google is the contracting party for the purchase: in Germany and the EU, Google sells apps and subscriptions as the so-called Merchant of Record. Payment and billing are governed by the Google Play terms. These Terms of Use govern the use of the app.
6. Cancellation
You cancel Migraine Compass Plus in Google Play through your Google account at play.google.com/store/account/subscriptions. There you also manage your subscription.
7. Withdrawal
You receive information on the statutory right of withdrawal from Google Play during the purchase; statutory rights remain unaffected.
8. Updates and changes to the app
During the term of Plus, I provide the updates that are necessary for Plus to remain in conformity with the contract, including security updates, and inform you about them (§ 327f BGB).
Beyond that, I only change Plus if there is a valid reason for it, the change costs you nothing extra and I inform you about it clearly and comprehensibly. If such a change impairs your access to Plus or its usability, I inform you in advance on a durable medium; you can then terminate the contract free of charge within 30 days (§ 327r BGB).
9. Not a medical device
Migraine Compass is not a medical device and does not replace professional medical advice.
The app helps you log your attacks, see your history and take an overview to your doctor's appointment. Do not derive any medical decisions from the entries and overviews in the app; with health questions, please turn to your doctor.
10. Liability
I am liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health.
In the event of a slightly negligent breach of essential contractual obligations, I am only liable for the typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. Otherwise, liability for slight negligence is excluded.
Mandatory statutory liability provisions remain unaffected.
11. Applicable law
German law applies; mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
12. Changes to these Terms of Use
A new version of these Terms of Use applies to contracts concluded after its publication. It applies to an ongoing subscription only if you expressly agree to it; otherwise the version that was in force at the time of your purchase continues to apply. Changes to the app itself are governed by section 8.
